Removal Proceedings/Deportation
Removal proceedings are typically conducted in Immigration Court by an immigration judge. An immigration judge conducts proceedings for deciding the inadmissibility or deportability of an alien. An alien placed in proceedings may be charged with any applicable ground of inadmissibility or any applicable ground of deportability.
The proceeding may take place in person, through video conference, or through telephone conference. The immigration judge shall decide whether an alien is removable from the United States. The determination of the immigration judge shall be based only on the evidence produced at the hearing.
We can help you what to say at master hearing and how to prepare for individual hearing/merits hearing. We work with you until the immigration court terminates or dismisses the removal proceedings so that you can remain in the United States.
When you are in deportation or removal proceedings, you can apply for various immigration benefits, which if granted, provide relief from removal, such as:
– adjustment to permanent resident status,
– cancellation of removal,
– certain waivers of inadmissibility,
– asylum,
– withholding of removal, and/or
– Convention against Torture (CAT).
Removal proceedings can also be terminated if the government’s charges are substantively and/or procedurally defective.
